Outdoor Seating for Restaurants and Taverns

  3. The Site Plan should include layout of tent (if used), jersey walls or other fixtures, deemed to be suitable by the City, that safely separate outdoor seating from vehicular traffic.
  4. Proof of insurance on the owner’s policies naming the City of Waukegan as an additional insured.

    Will there be a tent(s) larger than 10 ft x 10 ft or over 120 square feet?
    YOU and YOUR BUSINESS ( hereinafter referred to as "BUSINESS") recognizes that the use of City of Waukegan Streets, parking stalls, or rights-of-way, were not intended for the use as a dining space, for which BUSINESS now intends to use them, pursuant to the COVID-19 Restore Illinois Plan. As a result, and to the fullest extent permitted by law, BUSINESS shall defend, indemnify and hold harmless the City of Waukegan (the “CITY”), and CITY’s officers, employees, agents, and representatives (“Indemnified Parties”), from and against any claims, allegations, damages, awards, judgments, and expenses of every kind or character, including, but not limited to, attorney’s fees and expert costs, which may arise out of or result from in whole or in part from BUSINESS's, BUSINESS’s employees, agents, representative’s, or customers' use of the CITY’s streets, parking stalls, or rights-of-way for BUSINESS’s use during the COVID-19 outdoor dining orders, except to extent caused by the sole negligence or willful misconduct of indemnified parties. BUSINESS’s obligation to defend indemnified parties shall be immediate upon written notice by CITY to BUSINESS and BUSINESS shall, if requested by CITY, defend indemnified parties using counsel approved by CITY in its sole discretion.
  7. Acknowledgement of Understanding:
    "I have read this waiver of liability, assumption of risk, and indemnity agreement, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I sign the agreement freely and voluntarily, intending the City to rely upon this document to the greatest extent allowed by law. By typing my full name below, I acknowledge and understand that I am signing electronically this Hold Harmless and Indemnification Agreement.”
